Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the ecocleanupholstery.com website (the “Service”) operated by Ecoclean Upholstery (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Services Provided

Ecoclean Upholstery provides professional carpet and upholstery cleaning services in North Carolina, including but not limited to:

  • Carpet cleaning
  • Upholstery cleaning (sofas, chairs, etc.)
  • Area rug cleaning
  • Pet odor and stain removal
  • Allergen treatment
  • Disinfection services
  • Other related fabric cleaning services as offered on our website.

All services are subject to availability and our professional assessment upon arrival at the service location. We reserve the right to refuse service if conditions at the property pose a risk to our technicians or equipment, or if the requested service is outside our scope of expertise.

2. User Obligations

By using our Service, you agree to:

  • Provide accurate and complete information when requesting quotes, scheduling services, or communicating with us.
  • Ensure that the service area is accessible and free of major obstructions (e.g., small furniture, personal items) before our technicians arrive.
  • Inform us of any specific concerns, delicate materials, or pre-existing damage to carpets or upholstery prior to service commencement.
  • Secure any pets or valuable items before our technicians begin work. Ecoclean Upholstery is not responsible for pets or items not secured by the client.
  • Make payment for services rendered as per the agreed-upon terms.

3. Pricing and Payment Terms

  • Quotes: All quotes provided are estimates based on the information provided by the client. The final price may vary based on the actual condition of the items, size, specific treatments required, and any additional services requested on-site.
  • Payment: Payment is due in full upon completion of services, unless otherwise agreed upon in writing. We accept various forms of payment, as indicated on our website or by our technicians.
  • Late Payments: Ecoclean Upholstery reserves the right to charge late fees or interest on overdue payments, as permitted by North Carolina law.

4. Cancellations and Rescheduling

  • Client Cancellations/Rescheduling: Clients must provide at least [e.g., 24-48] hours’ notice for any cancellation or rescheduling of an appointment. Failure to do so may result in a cancellation fee.
  • Ecoclean Upholstery Cancellations/Rescheduling: We reserve the right to cancel or reschedule appointments due to unforeseen circumstances, such as equipment malfunction, staff illness, or severe weather conditions. We will make every effort to notify clients as soon as possible in such events.

5. Disclaimers and Limitation of Liability

  • No Guarantees: While we strive for excellent results, Ecoclean Upholstery does not guarantee the complete removal of all stains, odors, or damage, especially those that are permanent, aged, or caused by irreversible factors. We will always inform you of realistic expectations prior to service.
  • Damage: In the unlikely event of damage to your property directly caused by our technicians during service, Ecoclean Upholstery’s liability shall be limited to the cost of repair or replacement of the damaged item, up to the limits of our General Liability Insurance policy. Claims for damages must be reported within [e.g., 24] hours of service completion.
  • Indirect Damages: Ecoclean Upholstery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

6. Indemnification

You agree to defend, indemnify and hold harmless Ecoclean Upholstery and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) your interaction with our technicians during service provision.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of North Carolina, United States, without regard to its conflict of law provisions.

8. Dispute Resolution

Any dispute arising out of or related to these Terms or the services provided by Ecoclean Upholstery shall be resolved through good faith negotiations. If a resolution cannot be reached, the parties agree to pursue mediation prior to any litigation. Any legal action or proceeding related to the Service shall be brought exclusively in the state or federal courts located in North Carolina.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
